Lebanese barber charged over alleged Sydney gang-rape released on bail

A barber who is among four males charged over the horrific alleged six-hour gang-rape of a teenage girl in Liverpool in Sydney’s southwest has been released on bail.

Adam Abdul-Hamid, 19, was bailed to home detention in the NSW Supreme Court on Friday after Justice Hament Dhanji determined he would not pose an unacceptable risk to the community, but will be allowed to travel to work or meet his lawyers.

Abdul-Hamid was arrested at his family home in Heckenberg in June and charged with five counts of aggravated sexual assault, but the court heard it was not alleged that he performed any of the sexual assaults, Newswire reported.

Three other males aged, 14, 16, and 18, have also been charged but cannot be legally identified since they were under 18 at the time of the alleged gang-rape.

NSW Police allege a 17-year-old girl was approached by a male stranger, 16, who engaged her in conversation and followed her to her car at Liverpool Westfield Shopping Centre at about 5.30pm on December 15 last year.

When she reluctantly let the teenager inside he allegedly sexually assaulted her, and said he would get out if she drove him to Wheat Park in Sadlier, but when she arrived two more males got into the car and allegedly sexually assaulted her.

A fourth male then arrived in another car, and police allege the girl was then driven around in her own vehicle and sexually assaulted, at times by multiple males at once, while they allegedly filmed. She was left alone in her car at 11.30pm, contacted a friend and reported the alleged attack to police.

The court heard that Abdul-Hamid allegedly filmed part of the alleged attack on his phone, but Justice Dhanji said: “The complainant thinks the applicant was recording on his phone, but that’s not known. On the other hand, the fact that she thinks that would at least suggest some proximity to events.”

Justice Dhanji told the court that the prosecution case was relatively strong, but was also “contestable” as prosecutors do not allege Abdul-Hamid physically attacked the girl.

“He might be found to be complicit and therefore responsible … for the offences as a result of his participation in a joint criminal enterprise,” he said.

“Alternatively it may ultimately be put that if not party to an agreement he was present at the scene, intentionally assisting, encouraging the principal offender or offenders.”

He also told the court that Abdul-Hamid appeared to be the “least involved” of the four alleged co-offenders, and that with a trial not likely to occur until 2027 faced years on remand without being convicted.

According to a police fact sheet presented to the court Abdul-Hamid was alleged asked during the alleged gang-rape “do you want to have a turn?” to which is allegedly replied, “no, I’m alright”, the Australian Associated Press reported.

Abdul-Hamid, who the Daily Mail reported is from a Lebanese immigrant family and grew up in social housing, will face court again next month.
