A French court has declared that a perpetrator is “criminally irresponsible” after torturing and killing a father and his daughter in the French village of Villeneuve-lès-Maguelone.
The ruling, handed down on Nov. 27, 2025, means the Spanish national who killed an 80-year-old French retiree and his 56-year-old stepdaughter in December 2022 cannot be tried before a jury.
The investigating chamber of the Montpellier Court of Appeal in Hérault issued the decision, according to the Ouest France media outlet.
The news outlet indicates that a psychological examination concluded that the suspect “lacked the capacity to understand the nature of his actions” at the time of the events. He has since been transferred to a specialized psychiatric unit in Albi.
The suspect, a man of Spanish origin who regularly traveled without a ticket, was stopped and forced off a train by authorities. Suffering from a severe psychiatric crisis characterized by “hallucinations and delusions of a religious and megalomaniacal nature, according to medical evaluations,” he broke into a house. Inside, the two victims were attacked at random. The details of the case illustrate the extreme violence they suffered, with the suspect tying them up, torturing them, and slitting their throats. He also raped the woman several times before she was killed.
When arrested two days after the killings, the man, who was still at the location, said he had “obeyed voices and angels ordering him to commit the murders.”
He also told authorities he had taken marijuana and cocaine.
The court used expert reports to conclude that the suspect had a “total abolition of his discernment”—the capacity to understand his actions—at the time of the murders.
The court ordered the man be placed in a psychiatric hospital facility.
His lawyer, Majib Diab, said: “This decision is fair given his condition, and it is clear that he cannot be released for a long time.”
The victims’ family stated they had been expecting the decision and are “relieved that he cannot be released.”
He is currently hospitalized in a specialized unit in Albi.
