Poland’s Ordo Iuris Institute is arguing that rulings last week by Poland’s Supreme Administrative Court ordering the registration of same-sex marriages performed abroad are illegitimate and politically motivated.
Specifically, the institute stated via a post on X that the rulings violate Article 18 of Poland’s Constitution and its Family and Guardianship Code, with “activist judges” rewriting the law instead of interpreting it.
The May 7 rulings related to three marriages, two of which were concluded in Portugal and one in Germany.

At the center of their argument is the fact that both the constitution and legal code define a marriage as strictly between a man and a woman. However, the judges instead turned to the Court of Justice of the European Union (CJEU), which has issued its own ruling that member states must recognize marriages performed in other EU countries.
When the CJEU originally made its ruling, Polish Prime Minister Donald Tusk had been clear that Brussels cannot pressure Poland into anything, especially regarding such a controversial topic. However, his government has now responded to the NSA ruling with enthusiasm.
“Today, three more couples won their case before the Supreme Administrative Court regarding transcripts. Behind the verdicts, letters, and procedures are real people, their families, and stories of longing for happiness, love, and safety. You simply deserve all of this! There’s no point in waiting. It’s time!” Katarzyna Kotula, Secretary of State in the Chancellery of the Prime Minister and Government Plenipotentiary for Equality, wrote on X.
Ordo Iuris has slammed the CJEU’s ruling as judicial overreach by Brussels, comparing it to the 2015 U.S. Supreme Court decision in Obergefell v. Hodges, which legalized same-sex marriage nationwide in the United States, “over the expressed democratic will of dozens of states.” The group then referenced Justice Antonin Scalia calling the move a “judicial Putsch” in his dissent.
“Democracy cannot survive when courts appoint themselves as its masters,” the post reads.
