‘Stop filming, you little bastard’ – Despite hit-and-run homicide and threatening witnesses, Malik O. receives probation in Berlin

In Germany’s capital city of Berlin, Malik O. has been convicted for a hit-and-run negligent homicide while he was driving double the speed limit at 98 km/h (61 mph). However, his sentence of probation is raising eyebrows. If he does not commit another crime, he will serve no prison time.

The details around the hit-and-run are also significant. 27-year-old Malik also threatened witnesses at the scene, telling one of them, “Stop filming, you little bastard.”

On June 26, 2024, Malik O. was driving a borrowed, 585-horsepower Mercedes AMG SL 63 down Hermannstrasse at nearly twice the legal speed limit – allegedly due to stress involving his pregnant girlfriend, whom he was on his way to visit. At the intersection of Biebricher Strasse, he struck 67-year-old tile layer Said T., who was crossing the street just steps from his home.

The impact launched the victim more than 20 meters through the air. Said T., a Turkish national warmly known to locals as “Uncle Said,“ died at the scene. Instead of rendering aid, the driver fled, turning himself in to the police alongside his father an hour later.

During his trial at the Tiergarten District Court, the 28-year-old defendant, who was already known to police for other crimes, initially let his lawyer speak for him. Malik O. testified that he was driving to visit his pregnant girlfriend in Kreuzberg when traffic built up on Hermannstrasse due to a motorcade celebrating a Turkish victory in the European Championship. Attempting to bypass the congestion, he accelerated through a traffic light and overtook vehicles on the left.

“I slammed on the brakes, but caught him“, the defendant stated, adding: “I made mistakes and I regret them.”

While Malik O. maintained a remorseful demeanor during the trial, witnesses painted a vastly different picture of his behavior at the scene of the crash. Onlookers reported hearing a revving engine and the driver turning aggressive. When a bystander began recording the aftermath of the collision, the defendant shouted from the car: “Stop filming, you little bastard!“

An expert testified that the Mercedes reached a peak speed of 98 km/h and was still traveling at 91 km/h at the moment of impact, according to German news outlet BZ. The expert noted that had the defendant adhered to the 50 km/h speed limit, he would have been able to stop roughly 16 meters ahead of the pedestrian, meaning the fatal collision was entirely preventable.

The victim, Said T., is survived by three children living in Turkey.

Malik O. was convicted for negligent homicide, dangerous interference with road traffic, and a count of unauthorized fleeing from the scene. However, the court sentenced Malik O. to one year and ten months’ probation. He is only banned from driving for two years and six months.
