An Iraqi-born repeat offender accused of having sexual relationships with two female prison employees has won a court battle to retain his refugee status in Germany.
The Schleswig-Holstein Administrative Court overturned a July 2024 decision by the Federal Office for Migration and Refugees (BAMF) which had stripped 19-year-old Ahmad J. of his protected status.
In its May 20, 2026 ruling, cited by Bild, the court declared the agency’s decision unlawful and ordered the German government to cover the legal costs.
Ahmad arrived in Germany with his mother as a minor during the migrant crisis a decade ago, and received refugee status in 2017. He was later convicted of crimes including theft, aggravated assault, attempted robbery, extortionate kidnapping, aggravated extortion, and resisting arrest.
In July 2023, the Lübeck District Court sentenced him to three years in juvenile detention.
BAMF argued that his record showed he posed a danger to the public and revoked his refugee status, removing an important obstacle to his possible deportation to Iraq. However, Ahmad appealed this decision and won.
The administrative court acknowledged that his offenses were serious and could not be dismissed as a single lapse in judgment. A January 2025 risk assessment estimated that he had a 78 percent chance of committing further offenses.
However, the judge ruled that a serious criminal conviction alone was insufficient to justify withdrawing refugee protection. The court said authorities must establish that the individual still presents a concrete danger at the time of the hearing.
A second assessment completed in August 2025 reportedly found that Ahmad had matured, developed greater insight into his behavior, and improved his impulse control. The judge therefore concluded that the required current risk had not been proven.
BAMF said it was reviewing the ruling and could still appeal.
Ahmad is separately accused of receiving cellphones, jewelry, money and food deliveries while detained in Schleswig’s juvenile prison.
Prosecutors allege that he had sex with the facility’s former department head, then 28, and its psychologist, then 32. Some of the encounters allegedly took place inside prison offices while Ahmad was 17.
Both women lost their jobs and were later convicted.
