A Moroccan “minor” who claimed to be 17 years old when arrested for the rape of a 14-year-old girl in Madrid has been revealed to be 23, shifting his case from juvenile to adult court and exposing his long record of violent crime.
The attack occurred on Aug. 29 near the Hortaleza juvenile center, where the man was living under the guise of being an unaccompanied minor. According to police and medical reports, the victim was beaten, stripped, and raped.
Officers responding to the scene found the suspect, identified as Mohamed Rifai, hiding in the bushes nearby. As reported by OKdiario, he resisted arrest, punching and kicking the officers, threatening to kill them, and later lashing out violently in custody.
Once detained, Rifai vandalized his holding cell, threatened police and forensic staff, and refused to cooperate. His outbursts escalated to the point where authorities were forced to sedate him.
Though he presented himself as 17, forensic examinations of his teeth, wrist, and collarbones concluded he is at least 19, with a most probable age of 23.2. As a result, his case was formally transferred from the juvenile court to a regular one. The ruling stated that on the date of the attack, he was “in any case, over 18 years of age.”
This reclassification carries significant legal consequences. If convicted of rape as an adult, Rifai could face up to 15 years in prison. Had he been tried as a juvenile, the maximum penalty would have been eight years in a detention center.
It was later revealed that the suspect had already amassed 14 convictions in Spain, ranging from shoplifting to violent robbery and assaulting a police officer, before the alleged rape.
Vox leader Santiago Abascal criticized the legacy political parties in Spain for continuing the mass immigration policy that is threatening public safety. In a post on social media, he wrote, “The fact that these people are in Spain is the responsibility of all parties. All except VOX. They are guilty of opening their doors to them, of making some people rich by bringing them, of making others rich by serving them, and of making Spaniards, and in this case a poor Spanish girl, suffer the consequences every day.”
The revelation regarding Rifai’s age comes the same week that Spain’s socialist government began the gradual transfer of more than 600 Moroccan nationals claiming to be minors from the North African enclave of Ceuta to the Spanish mainland.
The decision has reignited debate in Madrid over how to manage unaccompanied minors entering the country, as new figures revealed just 41 of the nearly 30,000 minor arrivals since 2018 have been repatriated.
