Maryland Man Detained for a Month Says DC Police Lured Him Into ICE Custody

Late last year, after 37-year-old Jose Argueta reported the theft of his car to Montgomery County police, he received a call from D.C. police saying they’d recovered his car and he could pick it up at the Fifth District station, his attorney said.

But when Argueta walked into the police station, he was placed in custody by ICE agents, the Washington Post first reported.

Law enforcement sources told News4 the D.C. Office of Police Complaints also is investigating whether D.C. police lured Argueta to the police station so he could be detained by federal authorities.

According to a police report and a charging document for the man charged with stealing Argueta’s car, D.C. police from the Fifth District, along with federal agents and U.S. Park Police, were patrolling as part of the federal task force. They spotted the stolen white Hyundai Sonata in the 900 block of Franklin Street NE. When they tried to stop the car, the suspect fled.

The driver intentionally rammed one of the federal agents’ vehicles, injuring several agents, including one who had to be taken to a hospital, according to court documents. The chase ended in the 2700 block of 7th Street NE, where the suspect tried to run but was apprehended in an alley behind the 600 block of Girard Street NE.

According to the charging document, an MPD officer from the 5th District called Argueta to confirm it was his car.

Rose said Argueta only received one call from police. They told him to go to the Fifth District to get his car.
