Poland: Tusk seeks US extradition of former conservative justice minister ASAP

After Polish Prime Minister Donald Tusk announced he would be working hard to get former Justice Minister Zbigniew Ziobro extradited from the United States, Ziobro is warning that American justice may be on his side. The dispute has broken out in the wake of a senior Trump official apparently granting Ziobro the necessary visa for his trip from exile in Hungary to the U.S.

Poland’s prosecutor’s office has already prepared an extradition request, according to some media reports. However, it turns out that investigators cannot currently send any such request and would not be able to do so until September, as it requires a final court order for Ziobro’s arrest.

“At this time, the court has not considered the defense attorneys’ appeals, so the February 5th ruling is not final. The question of the reasons is a question for the court. The court should do so within seven days, so in February,” Przemysław Nowak, spokesperson for the National Prosecutor’s Office, told Wirtualna Polska, as cited by Do Rzeczy, earlier this year.

The issue is that the court’s decision to consider the defense attorneys’ appeal is not set to take place until Sept. 8., with over 6,000 investigation files alone to review. So it is not clear how Tusk plans to expedite an extradition.

More importantly, there is the U.S. side to consider, which Ziobro is clearly hoping will lean in his favor.

“It is in the interest of Poles that the world public learns the truth about the scale of lawbreaking in Poland and the use of the prosecutor’s office and courts for political infighting and repression. The case before an independent and impartial American judge will be an excellent opportunity for this. Therefore, I hope that you will not evade legal procedures and that your minister will submit the appropriate extradition request as soon as possible,” Ziobro wrote on X.

“In extradition cases between Poland and the US, an extradition treaty is in force. An independent American judge plays a key role in it. This is not a judge appointed by an illegally appointed court president to make a ruling suit the interests of your government – ​​as is happening today in Poland. This is a judge whose decision you cannot prejudge by writing an entry on X, as you did earlier, stating that I would be temporarily detained upon my return to Poland,” he continued.

“He is also a judge whom you will not be able to destroy with a smear campaign, dismissal from office and repression – as in the case of Judge Łubowski, who issued a ruling unfavorable to your interests in the Fund case and pointed out the scale of violations of the law by your government,” he added.
