The Trump administration warned Temporary Protected Status (TPS) holders Friday that they have only a short time left to self-deport before their legal status officially lapses, following the U.S. Supreme Court’s decision on terminating the protections.
The statement from the Department of Homeland Security’s (DHS) General Counsel, James Percival, came as thousands of immigrants with the status, from countries including Haiti and Syria, have been left in limbo in recent weeks, even as their work permits remain valid.
Percival said that this was down to lower courts not yet having acted on the Supreme Court’s ruling, and that the suggestion that work permits had been extended could not be “further from the truth.”
“For those with an expiring TPS designation, these final days provide one last opportunity to accept $2,600 and a free flight home,” he said on X. “We strongly suggest you take advantage of this generous offer.”

Percival said Friday that multiple TPS cases were “tied up in lower courts,” where judges were “dragging their feet” on lifting injunctions in the wake of the Supreme Court’s decision.

His comments come after some TPS recipients were initially told their permits would expire July 10, a deadline which passed without all cases being updated. That work authorization extension had covered nationals from Haiti, Syria, Burma, Yemen, Ethiopia, South Sudan, and Somalia, per DHS’s updates last week.
The General Counsel also said Friday that the Supreme Court decision would not go into effect until a month after it was announced, but that lower courts were still bound by the ruling anyway.

Business organizations, labor unions, and immigrant advocacy groups have warned that the administration’s decision to end work authorization for many TPS holders could have sweeping consequences for both workers and the U.S. economy.

Once TPS is officially revoked, it will largely mean holders no longer have legal status in the U.S., opening them up to removal proceedings.
