An African predator who left his teenage victim bleeding and traumatised after plying her with alcohol and raping her inside a unisex public toilet cubicle in Melbourne has been jailed.
Mostaf Abdiraham Haji Ali, 30, who previously pleaded guilty to false imprisonment, sexual assault and common law assault, was sentenced to two years and three months’ imprisonment with a non-parole period of 16 months in the County Court of Victoria on Friday, Hume Leader reported.
Ali, who police described as of African appearance while appealing for public assistance apprehending him after the assault, was born in Yemen and spent time in a refugee camp in Egypt before moving to New Zealand and then on to Australia about eight years ago.
The court heard Ali and a friend had been on a two-day drug and alcohol bender when they bumped into his 14-year-old victim and another 15-year-old girl in Melbourne’s CBD on January 1, 2022, and told them they were “sexy” and “hot” and could become strippers or porn stars.
When the girls refused to go back to the strangers’ hotel room, the men bought a 20-pack of vodka from a bottle shop and took them to a park in St Kilda.
Ali gave the 14-year-old nine drinks at an ice cream van, kissed her without consent, and asked her to go for a walk. When she refused he grabbed her arm, forced her into a nearby public toilet cubicle, locked the door, choked her and kissed her.
He then slapped her in the face four times while sexually assaulting her for 30 minutes, only stopping when blood started running down her inner thighs.
Ali then started to help her clean up and let her go, and she told an adult she had been forced to drink alcohol and sexually assaulted.
The court heard the victim had circular bruising on her neck, and that CCTV showed Ali taking the girl into the unisex public toilet cubicle with a bottle of alcohol and coming out again 30 minutes later without the bottle.
When Ali was tracked down and questioned at his home in Preston he denied being the man in the video and lied about his identity, and later minimised the offences to his psychologist, focusing more on the consequences for himself than on empathy for the victim, and a previous court hearing was told he had “no remorse”.
The girl’s mother said in a victim impact statement that she was worried the teenager would “never recover”, and wrote that the sexual assault would impact her daughter and the family forever.
Judge Pardeep Tiwana said the offending against a “14-year-old vulnerable girl” was “serious” and must have been “utterly terrifying”.
“You gave alcohol to your young victim, locked her for 30 minutes … you assaulted her sexually and violently … choking her (and you) kissed her aggressively, slapping her in her face four times,” he said.
