Prosecutors seek nine-year prison sentence for Senegalese migrant accused of raping disabled minor in Spanish garage

A 40-year-old Senegalese man denied raping a minor with an intellectual disability after appearing before the Palma Provincial Court on Monday.

The defendant, sitting with his interpreter, answered questions only from his lawyer and claimed he had never entered the garage in Manacor where the alleged sexual assault took place.

The court accepted as evidence a statement previously given by the victim, in which she stated she had met the accused through Instagram and had exchanged messages with him before agreeing to meet.

As reported by Ultima Hora, prosecutors allege the man went to the garage of the victim’s home at around 4 p.m. on April 30, 2020. They claim he knew she had a “clearly perceptible” intellectual disability.

According to the prosecution’s account, the defendant persuaded the teenager to open the garage door before entering the property. Once inside, he allegedly forced her to undress and touched her genitals.

The victim reportedly told him she did not want any form of sexual contact and asked him to allow her to leave.

Prosecutors allege the man prevented her from leaving and threatened to take a knife and kill either her or her sister if she continued to resist, Diario de Mallorca reported.

He then allegedly threw a mattress onto the garage floor and raped the teenager for approximately 10 minutes. The prosecution said the victim attempted to stop him but was unable to force him off of her.

The Public Prosecutor’s Office is seeking a nine-year prison sentence, followed by the defendant’s deportation from Spain after he has served three-quarters of his sentence.

Prosecutors are also requesting that he pay the victim €20,000 in compensation for the emotional harm she suffered.

Remix News has reported on several other cases in recent years involving the sexual assault of children with disabilities by migrants.

Last month, an 11-year-old girl with disabilities was allegedly sexually assaulted at a special-needs school in Koblenz, Rhineland-Palatinate.

A 20-year-old unemployed Afghan man, identified as Nassar S., is accused of entering the Hans-Zulliger School without authorization and assaulting the child at knifepoint inside a school bathroom. A suspected accomplice had not been apprehended at the time of the report.

The family’s lawyer told Bild newspaper, “The girl told me that one of the two young men was at the scene of the abuse, pulled down his pants. A knife was also involved.”

In May, a 17-year-old dual citizen of Sweden and Syria was charged with the aggravated rape of a child, while a 14-year-old was also investigated over the alleged rape of a 15-year-old girl with a disability.

The abuse was reportedly filmed and took place in November across four public bathrooms at a shopping center in Uppsala.

Investigators allege the two suspects acted “together and in concert,” using violence and threats to force the victim into vaginal and oral intercourse.

Although the victim was 15 at the time, she was treated as a child under the relevant legislation because her disability had resulted in a “reduced ability to protect their sexual integrity.”

In July 2023, an Afghan migrant was indicted over the alleged rape of a 15-year-old girl with a disability at a public swimming pool in Strasbourg.

The 26-year-old was also accused of sexually assaulting three other females, including two 15-year-old girls and a woman in her 40s, at swimming pools across the city.

Prosecutors alleged he first approached the disabled teenager at the Lingolsheim public swimming pool in May. Local media described the victim as “slightly disabled,” without providing further details.

In October 2024, a French former activist affiliated with the far-left La France Insoumise party in Nantes was indicted on allegations of raping and torturing a 4-year-old girl with a disability.

Pierre-Alain Cottineau, 32, was placed in pretrial detention after reportedly admitting to the allegations while in police custody.
