Two illegal immigrant men pleaded guilty to murdering a man in Fairfax County in 2024.
They faced up to 40 years in prison. But they are now set only to serve five years behind bars.
The reason why the two men will be serving five years behind bars for murder is that Fairfax County Commonwealth’s Attorney Steve Descano’s office offered them a generous plea deal. And both men took it.
Descano’s Office offered Maldin Anibal Guzman and Wis Alonso Sorto-Portillo a plea deal which included a 25-year sentence. But they will only be required to serve five of those years, including credit for time served. Meaning the men will be out in 2029.

Shortly after this story was published, Descano’s office told 7News, “The plea agreement was the only way to ensure that the defendants were incarcerated for this brutal murder. Since the victim’s body was found in a creek the next morning, there was no DNA or any physical evidence at the scene. All witnesses in this case were terrified to come forward or assist with prosecution.”
When 7News first reported on the murder in 2024, ICE said they issued multiple immigration detainers against Guzman to deport him. Still, the Fairfax County Sheriff’s Office refused to cooperate with ICE and honor the immigration detainers.
